• Judge Sotomayors Most Controversial Case

      A couple months back, Ainsley traveled to New Haven, CT to tell you the story of a group of firefighters who were suing the city because of a terrible instance of affirmative action gone wrong. The firefighters had all passed a test required for a promotion, but because no African-Americans scored high enough on the exam to receive a promotion, the city decided not to promote anyone. The white firefighters sued alleging race discrimination and took their case all the way to the Supreme Court where a decision is expected in the next month.

      But the story has added importance today, because it was then Circuit Court judge now Supreme Court nominee Sonia Sotomayor who joined an unsigned opinion at the Circuit Court level dismissing the firefighters' case, a decision that is widely expected to be overturned by the Supreme Court.
