Lindsay Lohan was arrested Wednesday morning in New York City after allegedly clipping a pedestrian with her Porsche Cayenne and leaving the scene.

The alleged victim, cook Jose Rodriguez, told The Daily News that Lohan “smelled like alcohol” and was "slurring" her words.

“They acted like I was nothing,” Rodriguez said. “That no one could touch her because she was rich and powerful.”

Lohan's rep had no comment, but a witness, who said she saw Lohan at a Slash concert shortly before the alleged incident, told TMZ that Lohan had not been drinking.

Police commissioner Ray Kelly said Lohan was not administered a breathalyzer test.

Lohan was pulling in to the Dream Hotel in downtown Manhattan when she allegedly hit the passerby. Lohan's friend got out to check for damages, and then Lohan and her entourage went into the hotel. Someone called police, and when Lohan left the hotel around 2 a.m., she was arrested.

Lohan was charged with leaving the scene of an accident, issued a ticket, and released.

The charge is a misdemeanor, and it could trigger a violation of her probation on theft charges, as her probation hinges on her obeying all laws.

The late night (early morning?) altercation is just the latest drama involving the 26-year-old actress. A couple weeks ago, producers of "Scary Movie 5" had to deal with Lohan's excuse that she had walking pneumonia when they tried to get her to show up for a day of filming with Charlie Sheen, The Post reported.

“Lindsay missed every meeting she had for the film, including script reads and wardrobe meetings,” an insider told The Post. “Then she missed her flight to Atlanta on Sunday to shoot the movie. The producers had been getting signs Friday that she was a mess, and would not be fit to work.”

Lohan ended up finally shooting the scene.

In August, Lohan was investigated by the Los Angeles Police Department over the purported theft of $100,000 worth of watches, sunglasses and monogrammed tableware from the home of multimillionaire friend Sam Magid. The L.A. County District Attorney decided not to prosecute on burglary charges due to “insufficient evidence.”

Lohan is still being investigated for lying to police after a car crash earlier this year in which she said she was the passenger, but cops suspect she was actually the driver. The case will be referred to prosecutors and the L.A City Attorney for potential probation violation.

A source closely linked to the star told FoxNews.com nothing Lindsay Lohan does surprises him anymore.

“Her problems are all catching up with her,” said the insider. “And Lindsay seems to spend all the money she makes.”
