LOS ANGELES – San Diego native Mariah Yeater alleges Justin Bieber impregnated her backstage at a concert a year ago when she was 19 and he was 16.
Beiber through his rep has denied the charge, saying it was “sad that someone would fabricate malicious, defamatory and demonstrably false claims. We will vigorously pursue all available legal remedies to defend and protect Justin against these allegations."
So who exactly is the woman who has turned Bieber Town upside down?
According to the court documents she filed to seek a paternity test and child support from Bieber, Yeater, 20, was on food stamps when she acquired front row tickets to Bieber’s Los Angeles concert last year, and was subsequently plucked from the crowd by security to meet the star backstage.
Yeater has never filed a tax return with the State of California nor the IRS.
Yeater has not graduated college and lists her highest level of education as 11th grade. The young woman started a new job on January 15, 2011 but has been unemployed since March 15, 2011, and over the last 12 months, claims an average paycheck of $125. She does, however, get $500 per month of public assistance.
Yeater also claims no investment income and no self employment, and alleges in the suit that the delivery of her son, Tristyn Anthony Markhouse Yeater, who was born on July 6, cost $25,000.
Yeater is asking a California court to force Bieber to "undergo a paternity test to scientifically confirm that he is in fact that father of my baby" and "provide adequate support for my baby." A court hearing has been set for December 15, and no father has been listed on the birth certificate.
Meanwhile, Bieber’s main squeeze, Disney darling Selena Gomez, appears to be taking the headline news in stride.
Hostess Gomez will be joined by beau Bieber in Belfast this weekend, where he will receive the first-ever MTV Voices Award, recognizing his philanthropic contributions, in addition to performing in the show.
Earlier Wednesday, Gomez – flanked by her publicist – was spotted donning sweats as she headed into a studio in Los Angeles, shying away from questions pertaining to the paternity suit.
Gomez has previously pledged that she will not have sex before marriage, and Bieber recently told Rolling Stone that he believes one should wait “for the person you’re in love with."
Under California law, Yeater may also be admitting to be a statutory rapist, having allegedly had intercourse with a minor. Yeater claims to be 19 and the time of the alleged incident, while Bieber was only 16.
“If someone over 18 has sex with someone under 18 it is called ‘unlawful sex with a minor’,” California Criminal Defense attorney David Wohl told FOX411’s Pop Tarts column. “I'm very surprised this woman would come forward claiming Bieber fathered her child. In most states this would be seen as an admission to statutory rape. Perhaps she feels it is worth the risk in order to cash in on some potentially huge child support dollars.”
Yeater could be faced with some serious consequences if her story turns out to be fabricated.
"If Ms.Yeater is making up these allegations and Justin Bieber is able to prove that in court by winning the case that she has filed, she may be liable for malicious prosecution under California law,” explained entertainment defamation attorney, Mitchell Langberg of Brownstein/Hyatt/Farber/Scheck LLP. “If that happens, she and her lawyers could be responsible to pay Bieber's attorneys' fees and other damages, but not for harm to his reputation. A libel or slander suit can almost never be based upon what someone says in a complaint. In fact, if he sues her for defamation, under California law he might end up being responsible to pay her attorney's fees. On the other hand, if she is making these same allegations directly to the press and Bieber can prove that they are false -- and that she knew it -- he may have a valid defamation claim."
